Terms of Service — Jashn

These Terms of Service ("Terms") govern your access to and use of the Jashn mobile application ("Jashn", "we", "our", or "the app"). By downloading, installing, or using Jashn you agree to be bound by these Terms. If you do not agree, do not use the app.

1. About Jashn

Jashn is a venue-discovery and booking platform operated by Jashn Hall Private Limited, Mathura, Uttar Pradesh, India. The platform connects guests looking to book event venues with venue owners ("Hosts") who list their properties on Jashn.

2. Eligibility

  • You must be at least 18 years old to create an account or make a booking.
  • You must provide accurate, current, and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You may not create multiple accounts or transfer your account to another person.
  • 3. User accounts

    3.1 Registration

    You may sign up using a mobile phone number, email address, or a supported social login provider (Google, Apple). One account per person is permitted.

    3.2 Account security

    You are solely responsible for all activity that occurs under your account. Notify us immediately at jashn.cxsupport@gmail.com if you suspect unauthorised access.

    3.3 Account termination

    We reserve the right to suspend or permanently delete accounts that violate these Terms, engage in fraudulent activity, or harm the platform or its users.

    4. Bookings and payments

    4.1 Booking requests

    Submitting a booking request does not constitute a confirmed reservation. A booking is confirmed only when the Host explicitly accepts it through the app.

    4.2 Pricing

    All prices displayed are in Indian Rupees (INR) and are set by the Host. Jashn does not guarantee the accuracy of pricing information and is not responsible for pricing errors made by Hosts.

    4.3 Cancellations and refunds

  • Cancellation and refund policies are set individually by each Host and are shown on the venue detail screen before you complete a booking.
  • Jashn may facilitate refunds as per the agreed policy but is not liable for disputes between guests and Hosts.
  • In cases of platform error, contact jashn.cxsupport@gmail.com or jashn.halls@gmail.com within 48 hours of the incident.
  • 4.4 No-shows

    If you fail to attend a confirmed booking without prior cancellation, you forfeit any amount paid subject to the Host's cancellation policy.

    5. Host responsibilities and terms

    5.1 General responsibilities

    If you list a venue on Jashn as a Host, you agree to:

  • Provide accurate, complete, and up-to-date information about your venue, including capacity, pricing, photos, amenities, and availability.
  • Honour all confirmed bookings and provide the services as advertised.
  • Comply with all applicable local laws, licensing requirements, fire safety codes, and health regulations.
  • Not charge guests outside the Jashn platform for services agreed within the app.
  • Promptly update your listing if any information changes.
  • Respond to booking requests within 24 hours.
  • Maintain professional and courteous communication with guests.
  • 5.2 Legal compliance and licensing

  • You represent and warrant that you have all necessary permits, licenses, and authorizations to operate your venue legally.
  • You are solely responsible for obtaining and maintaining all required business registrations, GST registration, trade licenses, and event venue permits.
  • You confirm that your venue complies with local zoning laws, building codes, fire safety regulations, and capacity restrictions.
  • Jashn is not responsible for verifying your legal compliance and assumes no liability for violations on your part.
  • 5.3 Property ownership and authorization

  • You confirm that you are the legal owner of the venue or have explicit written authorization from the owner to list and operate the venue for events.
  • You agree to provide proof of ownership or authorization upon request by Jashn.
  • If listing on behalf of another party, you represent that you have full authority to enter into this agreement.
  • 5.4 Insurance and liability

  • You are solely responsible for obtaining adequate insurance coverage for your venue, including public liability insurance, property damage insurance, and any other relevant policies.
  • Jashn does not provide insurance coverage for your venue or events held at your premises.
  • You accept full responsibility for any injuries, accidents, property damage, or losses occurring at your venue.
  • You agree that Jashn shall not be liable for any claims, damages, or losses arising from events hosted at your venue.
  • 5.5 Safety and security

  • You must ensure your venue meets all safety standards including emergency exits, fire extinguishers, first aid facilities, and adequate lighting.
  • You are responsible for the security and safety of guests attending events at your venue.
  • You must disclose any known safety hazards or limitations to guests before they confirm bookings.
  • You agree to maintain the venue in a safe, clean, and sanitary condition.
  • 5.6 Accurate representation

  • All photos, descriptions, amenities, and pricing information must accurately represent your venue.
  • You may not use misleading, deceptive, or fraudulent information in your listing.
  • You may not post photos of other properties or use images that do not represent your actual venue.
  • Jashn reserves the right to remove or suspend listings found to contain false or misleading information.
  • 5.7 Taxes and financial obligations

  • You are solely responsible for all tax obligations arising from your venue hosting services, including but not limited to GST, income tax, property tax, and entertainment tax.
  • Jashn does not withhold taxes on your behalf unless required by law.
  • You agree to maintain proper financial records and comply with all tax filing requirements.
  • You acknowledge that Jashn may report earnings to tax authorities as required by law.
  • 5.8 Prohibited activities

    As a Host, you may not:

  • Host illegal activities or events that violate local laws.
  • Discriminate against guests based on religion, caste, gender, ethnicity, disability, or any other protected characteristic.
  • Accept bookings you cannot fulfill or consistently cancel confirmed bookings.
  • Charge hidden fees or demand additional payments outside the platform.
  • Misrepresent your venue's capacity, amenities, or services.
  • Allow events that exceed your venue's legal capacity or safety limits.
  • 5.9 Dispute resolution and refunds

  • You agree to work with guests in good faith to resolve any disputes or issues.
  • In cases where guests are entitled to refunds due to your failure to provide agreed services, you authorize Jashn to process refunds on your behalf.
  • Repeated disputes or failure to resolve guest complaints may result in suspension or removal of your listing.
  • 5.10 Indemnification by Hosts

    As a Host, you agree to indemnify, defend, and hold harmless Jashn Hall Private Limited, its directors, officers, employees, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your breach of these Terms or any applicable laws.
  • Your venue operations or events hosted at your premises.
  • Any injuries, accidents, or property damage occurring at your venue.
  • Disputes with guests or third parties related to your venue.
  • Your failure to obtain necessary permits, licenses, or insurance.
  • Any false, misleading, or inaccurate information in your listing.
  • Any acts or omissions by you, your employees, or agents.
  • 5.11 Suspension and removal

    Jashn reserves the right to immediately suspend or permanently remove your venue listing and terminate your Host account if:

  • You violate these Terms or engage in prohibited conduct.
  • You receive multiple negative reviews or guest complaints.
  • You fail to honor confirmed bookings without valid reason.
  • Your venue is found to be unsafe, illegal, or non-compliant with regulations.
  • You engage in fraudulent activity or circumvent the platform.
  • You fail to respond to booking requests or maintain communication with guests.
  • No refund of any fees paid will be provided in case of suspension or removal for Terms violations.

    5.12 No guarantee of bookings

  • Jashn does not guarantee any minimum number of bookings, revenue, or guest traffic to your venue.
  • Listing your venue on Jashn does not create an employment, partnership, agency, or joint venture relationship.
  • You are an independent service provider and are solely responsible for your business operations.
  • 5.13 Service fees and payments

  • Jashn may charge service fees or commissions on bookings made through the platform.
  • Fee structures will be communicated to you and may be updated with reasonable notice.
  • Payments to Hosts are subject to Jashn's payment processing terms and may be held pending confirmation that services were provided as agreed.
  • You authorize Jashn to withhold or deduct amounts for refunds, chargebacks, or disputes.
  • Jashn reserves the right to remove listings that are inaccurate, misleading, or in violation of these Terms.

    6. Prohibited conduct

    You agree not to:

  • Use the app for any unlawful purpose or in violation of any applicable laws.
  • Post false, misleading, or fraudulent content including reviews, venue details, or booking information.
  • Harass, threaten, or abuse other users, Hosts, or Jashn staff.
  • Attempt to reverse-engineer, decompile, or tamper with any part of the app.
  • Use automated bots, scrapers, or scripts to access the platform.
  • Circumvent the platform by conducting transactions outside of Jashn to avoid fees or obligations.
  • Upload content that infringes third-party intellectual property rights.
  • Engage in spamming, phishing, or other deceptive practices.
  • 7. User content

    By submitting reviews, photos, messages, or any other content ("User Content") through Jashn, you:

  • Grant Jashn a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your User Content for platform and marketing purposes.
  • Confirm that you own or have the right to share the content.
  • Acknowledge that Jashn may remove content that violates these Terms or our community guidelines.
  • We do not claim ownership of your User Content.

    8. Intellectual property

    All app design, code, trademarks, logos, and platform content are the intellectual property of Jashn Hall Private Limited. You may not reproduce, distribute, or create derivative works without our express written permission.

    9. Disclaimers

  • Jashn is a marketplace platform and is not a party to transactions between guests and Hosts.
  • We do not verify the accuracy of all venue listings and make no guarantees about venue quality, safety, or availability.
  • The app is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted or error-free operation of the app.
  • 10. Limitation of liability

    To the maximum extent permitted by applicable law, Jashn Hall Private Limited and its officers, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of the app.
  • Any loss of revenue, profits, or data.
  • Any disputes between guests and Hosts.
  • Our total aggregate liability for any claim shall not exceed the amount you paid through the Jashn platform in the 30 days preceding the claim.

    11. Indemnification

    You agree to indemnify and hold harmless Jashn Hall Private Limited, its affiliates, officers, and employees from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the app, your User Content, or your violation of these Terms.

    12. Governing law and disputes

    These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mathura, Uttar Pradesh, India. We encourage you to contact us first at jashn.halls@gmail.com or jashn.cxsupport@gmail.com to resolve disputes informally before pursuing legal action.

    13. Changes to these Terms

    We may update these Terms from time to time. When we do, we will update the "Last updated" date and notify you via an in-app message if the changes are material. Continued use of Jashn after changes take effect constitutes your acceptance of the updated Terms.
