These Event Host Terms & Conditions ("Terms", "Agreement", or "Event Host Terms") govern the relationship between Jashn Hall Private Limited ("Jashn", "Company", "we", "our", or "us") and any individual, business, organization, promoter, organizer, or authorized representative ("Event Host", "you", or "your") that lists, promotes, organizes, or sells tickets for an event through the Jashn mobile application, BookMyJashn website, or any related service (collectively, the "Platform"). By registering as an Event Host, submitting an event for listing, publishing event information, making tickets available for sale, or otherwise using the Platform as an Event Host, you acknowledge that you have read, understood, and agreed to these Terms.

1. Definitions

For purposes of these Terms: "Customer" means any person who accesses the Platform, discovers an Event, purchases a Ticket, or otherwise interacts with an Event Host through the Platform. "Event" means any concert, show, party, workshop, exhibition, festival, performance, conference, gathering, entertainment program, or other event listed on the Platform. "Event Host" means the person, business, organization, promoter, organizer, or authorized representative responsible for creating, organizing, managing, or conducting an Event. "Ticket" means any ticket, pass, entry entitlement, booking confirmation, or other admission right made available through the Platform. "Gross Sales Value" means the total value of Tickets successfully sold through the Platform for an Event, before deduction of Jashn's commission and applicable charges, subject to exclusions, refunds, cancellations, reversals, or other adjustments expressly provided under these Terms. "Platform" means the Jashn mobile application, BookMyJashn website, and related services operated by Jashn.

2. Role of Jashn

Jashn is a technology-enabled marketplace that facilitates discovery of Events and transactions between Customers and independent Event Hosts. Jashn provides the technological infrastructure through which Event Hosts may list Events, display Event information, make Tickets available, and facilitate Ticket sales. Unless expressly stated otherwise, Jashn does not organize, own, manage, sponsor, supervise, control, or conduct the Event. The Event Host remains solely responsible for the Event, including its organization, execution, venue arrangements, performers, staff, permissions, safety, Ticket terms, and Customer experience. The contractual relationship concerning attendance at and participation in the Event exists primarily between the Customer and the Event Host.

3. Event Host Eligibility and Authority

The Event Host represents and warrants that:

  • You are legally competent to enter into this Agreement
  • You have the authority to organize and list the Event
  • You have obtained or will obtain all necessary permissions, licences, registrations, approvals, and consents
  • The Event does not violate applicable laws or regulations
  • All information provided to Jashn is accurate and complete
  • You have the authority to sell Tickets for the Event
  • You have obtained necessary rights from performers, artists, speakers, venues, content owners, and other relevant parties
  • You will comply with these Terms and applicable law. If you act on behalf of an organization or entity, you represent that you are authorized to bind that entity

4. Event Registration and Verification

The Event Host may be required to provide information and documents necessary for Event verification and listing.

Such information may include:

  • Event name
  • Event description
  • Event date
  • Event time
  • Event venue
  • Event photographs
  • Event category
  • Ticket categories
  • Ticket prices
  • Ticket inventory
  • Age restrictions
  • Organizer information
  • Contact details
  • Bank and settlement details
  • PAN/GST details where applicable
  • Licences, permissions, or approvals where applicable

Jashn may request additional information or documents before approving or continuing an Event listing. Jashn may reject, suspend, modify, restrict, or remove an Event where information is incomplete, inaccurate, misleading, unlawful, unverifiable, or inconsistent with Platform policies.

5. Event Listing Information

The Event Host is solely responsible for ensuring that all Event information displayed on the Platform is accurate, complete, current, and not misleading. The Event Host shall ensure that the listing accurately reflects:

  • Event date
  • Event time
  • Event venue
  • Event description
  • Ticket categories
  • Ticket prices
  • Ticket availability
  • Age restrictions
  • Entry requirements
  • Event rules
  • Performer or artist information
  • Organizer information
  • Any material restrictions or conditions

The Event Host shall promptly notify Jashn of any material change to Event information. Jashn may format, categorize, resize, edit, or otherwise modify Event Content for technical, presentation, or promotional purposes without changing the substantive meaning of the information provided.

6. Event Content and Intellectual Property

The Event Host may provide photographs, videos, artwork, posters, logos, descriptions, music, promotional material, performer information, and other content ("Event Content") for publication on the Platform. The Event Host represents and warrants that it owns or has obtained all necessary rights and permissions to use and provide such Event Content. The Event Host grants Jashn a non-exclusive, royalty-free licence to use, reproduce, display, format, distribute, promote, and otherwise use the Event Content in connection with operating, marketing, advertising, and improving the Platform and promoting the Event. The Event Host shall not submit content that infringes any third-party intellectual property, privacy, publicity, or other rights.

7. Event Approval

Submission of an Event does not guarantee that the Event will be published on the Platform. Jashn may review Event information before publication. Jashn may approve, reject, modify, restrict, suspend, or remove an Event listing at its reasonable discretion where necessary to maintain Platform standards, protect Customers, comply with applicable law, or prevent fraud or misuse.

Event approval by Jashn does not constitute an endorsement, sponsorship, certification, or guarantee of the Event.

8. Ticket Pricing

The Event Host shall determine Ticket prices, subject to applicable laws and Platform requirements. The Event Host shall ensure that Ticket prices displayed on the Platform are accurate and clearly communicated. Any applicable taxes, fees, charges, restrictions, or conditions relating to Ticket purchases must be properly disclosed. The Event Host shall honour the Ticket price applicable at the time of purchase unless a change is permitted under the applicable booking terms or required by law.

9. Ticket Inventory

The Event Host is responsible for providing accurate Ticket inventory to Jashn. The Event Host shall not intentionally oversell Tickets beyond the Event's lawful or safe capacity. The Event Host shall promptly update Jashn regarding changes to Ticket inventory. The Event Host remains responsible for ensuring that the number of Tickets sold does not exceed the permitted capacity of the Event venue or applicable legal limit.

10. Event Host Commission

For Ticket sales generated through Jashn, the Event Host shall pay Jashn a commission equal to: 5% of the Gross Sales Value Applicable GST at 18% shall be charged on Jashn's commission, or such other rate as may be applicable under law. Applicable payment gateway charges of 2.5% shall also apply in accordance with the payment arrangement displayed or communicated by Jashn.

Jashn may revise its commercial terms by providing appropriate notice to Event Hosts.

11. Gross Sales Value

For purposes of calculating Jashn's commission, Gross Sales Value shall generally include the value of Tickets successfully sold through the Platform. Unless otherwise communicated by Jashn, amounts relating to Tickets that are fully cancelled and refunded may be excluded from the final commission calculation. Jashn may make reasonable adjustments for:

  • Refunds
  • Cancellations
  • Chargebacks
  • Payment reversals
  • Fraudulent transactions
  • Duplicate transactions
  • Complimentary Tickets
  • Promotional adjustments; or
  • Other transaction corrections

Jashn may provide the Event Host with transaction or settlement information showing the applicable calculation.

12. Payment Processing

Ticket payments may be processed through authorized third-party payment service providers. Payment processing is subject to the applicable terms and security practices of the payment service provider. Jashn does not store sensitive payment credentials such as:

  • Credit card numbers
  • Debit card numbers
  • CVV numbers
  • UPI PINs
  • Banking passwords

Jashn shall not be responsible for payment failures, banking errors, network failures, gateway failures, or delays attributable to third-party payment providers.

13. Settlement and Payouts

Where Jashn facilitates Ticket sales and settlement to the Event Host, settlement shall be made according to the applicable settlement schedule. Before settlement, Jashn may deduct or adjust:

  • Jashn's commission
  • Applicable GST
  • Payment gateway charges
  • Refunds
  • Chargebacks
  • Payment reversals
  • Taxes or statutory deductions where applicable
  • Other amounts payable by the Event Host

The Event Host shall provide accurate bank, tax, and other information required for settlement. Jashn may delay or withhold settlement where reasonably necessary to investigate fraud, disputes, chargebacks, suspicious transactions, or other legitimate risks.

13.1 Settlement Reserve

To manage refund, cancellation, chargeback, payment reversal, fraud, and other transaction-related risks, Jashn may retain a reasonable reserve from the Ticket proceeds. The amount of such reserve may be determined by Jashn based on factors including:

  • Event value
  • Cancellation risk
  • Chargeback risk
  • Event Host's transaction history and performance
  • Time remaining before the Event
  • Verification status of the Event Host; and
  • Other relevant payment, operational, or business risks.

The Settlement Reserve shall not constitute an additional fee or commission payable to Jashn. It shall represent an amount temporarily retained from the Event Host's settlement for legitimate risk-management purposes. Unless required to address refunds, chargebacks, payment reversals, disputes, or other amounts lawfully recoverable from the Event Host, the applicable reserve may be released after successful completion of the Event and expiry of the applicable settlement or refund-risk period. Jashn may use or adjust the Settlement Reserve, to the extent permitted by applicable law, towards:

  • Customer refunds arising from Event cancellation
  • Chargebacks
  • Payment reversals
  • Fraudulent or unauthorized transactions; and
  • Other amounts lawfully recoverable from the Event Host. If the Settlement Reserve is insufficient to cover amounts lawfully payable or recoverable from the Event Host, the Event Host shall remain responsible for the outstanding balance.

Jashn may communicate the applicable reserve amount and settlement schedule to the Event Host through the Platform or other electronic communication channels

14. Taxes

The Event Host is responsible for all taxes, duties, levies, registrations, filings, and statutory obligations relating to the Event and Ticket sales, except taxes that Jashn is legally required to collect or pay on its own services. The Event Host shall provide valid tax and invoicing information where required.

15. Event Licences, Permissions and Legal

COMPLIANCE The Event Host is solely responsible for obtaining and maintaining all licences, permissions, registrations, approvals, and consents required for the Event. Depending on the nature of the Event, these may include:

  • Venue permissions
  • Municipal permissions
  • Police permissions
  • Fire and safety approvals
  • Music and performance licences
  • Copyright permissions
  • Public performance permissions
  • Food and beverage permissions
  • Alcohol-related permissions where applicable
  • Artist or performer agreements
  • Tax registrations
  • Other statutory approvals

Listing or approval of an Event by Jashn does not mean that Jashn has verified or granted any such permission. The Event Host shall immediately notify Jashn of any cancellation, suspension, expiry, or restriction affecting a required licence or permission.

16. Event Venue

The Event Host is responsible for ensuring that the Event venue is lawfully available and suitable for the Event. Where the Event Host uses a third-party Venue Partner, the Event Host is responsible for obtaining the necessary authorization and complying with the Venue Partner's applicable terms. Jashn is not responsible for disputes between the Event Host and the Venue Partner.

17. Event Execution and Management

The Event Host is solely responsible for conducting and managing the Event. This includes:

  • Event setup
  • Entry and admission
  • Ticket scanning or verification
  • Crowd management
  • Security
  • Staff
  • Performers
  • Event schedule
  • Sound and lighting
  • Food and beverages
  • Facilities
  • Customer assistance
  • Health and safety
  • Emergency arrangements

Jashn does not supervise or control Event operations.

18. Customer Experience

The Event Host shall provide Customers with the Event experience substantially as described in the listing. The Event Host shall not materially alter the Event after Ticket sales without promptly notifying Jashn and affected Customers. Any material change to the Event, including significant changes to date, venue, timing, headline performer, or nature of the Event, shall be communicated promptly.

19. Event Cancellation by Event Host

If an Event Host cancels an Event after Tickets have been sold, the Event Host shall immediately notify Jashn and provide all information reasonably required by Jashn to process the cancellation and communicate with affected Customers.

Where the cancellation is attributable to the Event Host, Jashn may suspend further Ticket sales and initiate refunds to affected Customers in accordance with the applicable refund policy and applicable law. The Event Host shall be responsible for amounts that are required to be refunded to Customers as a result of the Event Host's cancellation, subject to applicable law. Jashn may recover or adjust such refund amounts from:

  • Pending settlements
  • Current or future amounts payable to the Event Host
  • Amounts otherwise held by Jashn in connection with the Event; or
  • Any other lawful recovery mechanism. If the amount available for settlement is insufficient to cover the applicable refunds, the Event Host shall remain liable for the outstanding amount and shall pay such amount to Jashn within the period communicated by Jashn

19.1 Jashn's Commission on Cancelled Events

Jashn's commission shall generally apply only to completed and non-refunded Ticket sales. Where Tickets are cancelled and fully refunded due to cancellation of the Event by the Event Host, Jashn may reverse or adjust the corresponding commission calculation. However, any applicable payment gateway charges, banking charges, transaction costs, or other third-party charges that are non-refundable or have already been incurred may be deducted or recovered from the Event Host to the extent permitted by applicable law and the applicable payment arrangement.

19.2 Customer Communication

Jashn may communicate the cancellation and applicable refund information to affected Customers through the Platform, email, SMS, or other available communication channels. The Event Host shall cooperate with Jashn in providing accurate information required for such communication. The Event Host shall not independently provide Customers with information that contradicts the official cancellation or refund information communicated through Jashn.

19.3 Consequences of Event Host Cancellation

Where an Event Host repeatedly cancels Events, cancels an Event after substantial Ticket sales, or otherwise causes significant Customer disruption, Jashn may, subject to applicable law:

  • Suspend or remove the Event
  • Suspend or restrict the Event Host account
  • Restrict future Event listings
  • Withhold or delay settlements
  • Recover applicable refund amounts and losses
  • Require additional verification or security before allowing future listings; and
  • Terminate the Event Host relationship.

Nothing in this section limits Jashn's rights under the other provisions of these Terms

19.4 Cancellation to Circumvent the Platform

An Event Host shall not cancel an Event for the purpose of redirecting Customers to another event, venue, platform, payment channel, or transaction outside Jashn in order to avoid Jashn's applicable fees or commissions. Any such conduct may be treated as circumvention and may result in the actions described under the Non-Circumvention provisions of these Terms.

20. Event Postponement or Rescheduling

If an Event is postponed or rescheduled, the Event Host shall promptly provide Jashn with:

  • The reason for the change, where appropriate
  • The revised date and time
  • The revised venue, if applicable
  • Any material changes to the Event

Jashn may notify affected Customers through the Platform or other available communication channels. Refund eligibility shall be determined in accordance with the applicable Jashn policies, Event terms, and applicable law.

21. Ticket Refunds

Refunds arising from Event cancellation, postponement, rescheduling, or other circumstances shall be handled in accordance with the applicable refund policy communicated to Customers. Where the Event Host is responsible for the circumstances giving rise to a refund, Jashn may recover the applicable refund amount from amounts payable to the Event Host or otherwise seek recovery from the Event Host, subject to applicable law.

22. Customer No-show

Where a Customer purchases a valid Ticket but does not attend the Event, no refund shall be due solely because of non-attendance unless otherwise provided under the applicable Ticket terms or required by law. The Event Host shall not impose additional charges on a Customer merely for failing to attend where no such charge was disclosed at the time of purchase.

23. Chargebacks and Payment Reversals

If a Customer initiates a chargeback, payment reversal, payment dispute, or other claim relating to a Ticket transaction, Jashn may temporarily withhold, suspend, or adjust the corresponding settlement amount while the matter is investigated or resolved. The Event Host shall reasonably cooperate with Jashn, payment gateways, banks, and other relevant parties in resolving such disputes. Where a payment is subsequently reversed, refunded, charged back, or determined to be invalid, Jashn may recover the corresponding amount from the Event Host's current or future settlements, subject to applicable law. Jashn may temporarily restrict or suspend settlements where reasonably necessary to protect against fraud, unauthorized transactions, chargebacks, or other payment-related risks.

24. Fraud and Suspicious Activity

Jashn may monitor Event listings, Ticket transactions, and Platform activity for fraud, misuse, suspicious activity, or violations of applicable law. Jashn may request additional information or documentation from the Event Host. Where reasonably necessary, Jashn may delay, restrict, suspend, cancel, or review an Event, Ticket transaction, or Event Host account. Such action may be taken to protect Customers, Event Hosts, Jashn, payment providers, or other Platform participants.

25. Event Host Account Security

The Event Host is responsible for maintaining the confidentiality of its Platform login credentials and for activity conducted through its account. The Event Host shall immediately notify Jashn of suspected unauthorized access or account compromise. Jashn shall not be responsible for losses arising from the Event Host's failure to maintain appropriate account security, except to the extent caused by Jashn's own acts or omissions.

26. Non-circumvention

Event Hosts shall not intentionally encourage, solicit, induce, or attempt to persuade Customers introduced through the Platform to complete Ticket purchases, bookings, or related transactions outside the Platform for the purpose of avoiding Jashn's applicable commissions, fees, or charges. This restriction does not prevent legitimate communication between the Event Host and Customer that is reasonably necessary to conduct or fulfil the Event. If Jashn reasonably determines that an Event Host has deliberately attempted to circumvent the Platform, Jashn may:

  • Suspend or restrict Event listings
  • Reduce listing visibility
  • Suspend the Event Host account
  • Withhold or delay payouts
  • Recover applicable commissions or losses
  • Remove Events from the Platform
  • Terminate the Event Host account; and
  • Take appropriate legal action where necessary

27. Customer Data

Customer information made available to the Event Host through the Platform shall be used only for legitimate purposes connected with the Event and Ticket fulfilment. The Event Host shall not sell, rent, disclose, or otherwise misuse Customer information. The Event Host shall comply with applicable privacy and data-protection laws. Jashn's collection and processing of personal information is governed by the Jashn Privacy Policy.

28. Event Content and Promotion

The Event Host authorizes Jashn to use Event Content for listing, marketing, advertising, social media promotion, search results, notifications, promotional campaigns, and other legitimate Platform purposes. The Event Host acknowledges that Jashn may display Event information across its website, application, social media channels, advertisements, and other promotional channels. The Event Host shall ensure that all promotional claims relating to the Event are accurate and lawful.

29. Reviews and Customer Feedback

Customers may submit reviews, ratings, comments, photographs, videos, or feedback relating to an Event. The Event Host shall not:

  • Create fake reviews
  • Manipulate ratings
  • Threaten or pressure Customers
  • Offer prohibited incentives for reviews
  • Attempt to remove genuine negative reviews through improper means

Jashn may moderate, remove, restrict, or investigate user-generated content that violates Platform policies or applicable law.

30. Prohibited Events and Activities

Event Hosts shall not list or conduct Events involving unlawful activities or content prohibited by applicable law or Platform policies. Jashn may prohibit or restrict Events involving:

  • Fraud
  • Illegal activities
  • Violence or incitement to violence
  • Activities prohibited by law
  • Misleading or deceptive promotions
  • Unauthorized gambling
  • Unauthorized use of copyrighted content
  • Activities requiring licences or permissions that have not been obtained
  • Any activity presenting an unreasonable safety or legal risk

Jashn may remove or reject any Event that violates these requirements.

31. Duplicate or Misleading Listings

Event Hosts shall not create duplicate, misleading, or multiple Event listings for the purpose of manipulating search results, increasing visibility, misleading Customers, or circumventing Platform policies. Jashn may merge, modify, suspend, or remove duplicate or misleading listings.

32. Verification Rights

Jashn may verify information relating to an Event, Event Host, venue, Ticket inventory, pricing, licences, permissions, or other relevant matters.

The Event Host shall reasonably cooperate with verification requests and provide supporting documents where required. Jashn may suspend an Event listing until satisfactory verification is completed.

33. Staff, Contractors and Performers

The Event Host remains responsible for the acts and omissions of its employees, performers, artists, contractors, subcontractors, security personnel, volunteers, and other service providers engaged in connection with the Event, to the extent permitted by applicable law. The Event Host shall ensure that such persons comply with applicable laws and Event requirements.

34. Insurance

The Event Host shall maintain such insurance coverage as may be reasonably appropriate or legally required for the nature, size, location, and risk profile of the Event. Jashn does not provide insurance coverage for the Event Host, Event, venue, performers, Customers, employees, contractors, or property unless expressly stated otherwise.

35. Force Majeure

Neither Jashn nor the Event Host shall be liable for delays, interruptions, cancellations, or failures caused by events beyond its reasonable control ("Force Majeure Event"). Force Majeure Events may include:

  • Floods
  • Earthquakes
  • Fires
  • Pandemics
  • Epidemics
  • Government restrictions or orders
  • Curfews
  • Riots or civil unrest
  • Terrorism
  • War
  • Natural disasters
  • Utility failures
  • Internet or telecommunications outages
  • Transportation disruptions
  • Strikes or labour disruptions; and
  • Other events beyond the reasonable control of the affected party

The affected party shall, where reasonably practicable, notify the other party and take reasonable steps to mitigate the effects. Where a Force Majeure Event affects an Event, refunds, credits, rescheduling, or other arrangements shall be handled in accordance with applicable Jashn policies, Event terms, and applicable law.

36. Representations and Warranties

The Event Host represents and warrants that:

  • The Event information is accurate
  • The Event Host has authority to organize and list the Event
  • All required licences and permissions have been or will be obtained
  • Ticket sales are lawful
  • Event Content does not infringe third-party rights
  • Ticket inventory accurately reflects available capacity
  • The Event Host will honour valid Tickets
  • The Event will be conducted in compliance with applicable laws
  • The Event Host will comply with these Terms

37. Indemnification

To the fullest extent permitted by applicable law, the Event Host agrees to indemnify and hold harmless Jashn Hall Private Limited, its directors, officers, employees, agents, affiliates, and representatives from claims, losses, liabilities, damages, penalties, costs, and expenses arising from:

  • The Event
  • Ticket sales
  • Event cancellation or postponement
  • Event operations
  • Venue arrangements
  • Performer or artist disputes
  • Breach of these Terms
  • Violation of applicable law
  • Inaccurate Event information
  • Intellectual property infringement
  • Customer claims relating to the Event
  • Misuse of Customer information
  • Negligence or misconduct of the Event Host or its personnel

38. Limitation of Liability

To the fullest extent permitted by applicable law, Jashn shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Event Host's use of the Platform or dealings with Customers. Jashn does not guarantee:

  • A minimum number of Ticket sales
  • Event attendance
  • Revenue
  • Event success
  • Customer satisfaction
  • Promotional reach

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

39. Suspension and Removal

Jashn may suspend, restrict, reduce visibility of, or remove an Event or Event Host account where:

  • Event information is false or misleading
  • Required licences or permissions are unavailable
  • Fraud or suspicious activity is detected
  • Customers report serious concerns
  • The Event violates Platform policies
  • The Event violates applicable law
  • The Event Host repeatedly cancels Events
  • The Event Host attempts to circumvent Jashn
  • Payment obligations remain outstanding
  • Such action is required for legal or regulatory reasons

Where reasonably practicable, Jashn may provide notice before taking such action.

40. Termination

Either party may terminate the Event Host relationship subject to outstanding contractual and financial obligations. Termination shall not affect rights or obligations accrued before termination. Tickets already sold may continue to be governed by the applicable Ticket terms and refund policies. Amounts payable to Jashn before termination shall remain payable.

41. Confidentiality

The Event Host shall maintain the confidentiality of non-public commercial, financial, technical, Customer, transaction, and Platform information obtained through its relationship with Jashn. This obligation shall not apply to information that:

  • Is publicly available without breach
  • Was lawfully known before disclosure
  • Is independently developed; or
  • Must be disclosed under applicable law

42. Electronic Communications and Notices

The Event Host agrees that Jashn may communicate with it through email, telephone, SMS, application notifications, website notifications, or other electronic means using the contact information provided by the Event Host. Electronic communications shall constitute valid communication for Platform-related matters, subject to applicable law. The Event Host is responsible for keeping its contact and account information accurate and updated.

43. Changes to These Terms

Jashn may modify, update, replace, or revise these Terms from time to time to reflect changes in the Platform, business model, applicable law, or operational requirements. Updated Terms may be communicated through the Platform, email, or other appropriate means. Continued use of the Platform after the effective date of revised Terms may constitute acceptance of the updated Terms, subject to applicable law.

44. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to applicable law, disputes arising between Jashn and the Event Host in relation to these Terms shall be subject to the jurisdiction of the competent courts at Mathura, Uttar Pradesh, India.

45. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to remain in full force and effect to the extent permitted by applicable law.

46. Entire Agreement

These Terms, together with the applicable Jashn Privacy Policy, Legal Notices & Disclaimers, Refund & Cancellation Policy, and any separately executed agreement between Jashn and the Event Host, constitute the understanding governing the Event Host's use of the Platform. In case of conflict, the terms of a separately executed written agreement between Jashn and the Event Host shall prevail to the extent of the conflict.
